Waiver of Liability
In enrolling at Sportsplex West, participant understands that he/she or the team that he/she oversees attending the programs and using Sportsplex West and the facilities along with any off premises facilities does so at his/her own risk. Sportsplex West and its owners, employees or agents, shall not be liable for any damage whatsoever arising from any personal injury or property loss sustained by participant with his/her family in or about any programs on the premises as well as activities sponsored by Sportsplex West on grounds off premises. Participants and parents assume full responsibility for all injuries and damages which occur in or about any programs on the premises, He/She does hereby fully and forever release discharged hold harmless Sportsplex West, all associated facilities and its owner, employees, and agents from any and all claims, demands, damages or rights of action, present or future resulting from any person’s participation in any programs or use of the facility. In addition, he/she agree(s) to follow the rules of conduct and play set by Sportsplex West. Failure to do so may result in suspension from participation. Consent: I the undersigned parent or guardian/participant do hereby grant authority to the staff at Sportsplex West to render a judgement concerning medical assistance or hospital care in the event of an accident or illness during my absence. I do hereby authorize Sportsplex West and its assigns to utilize any and all photographs, pictures or other likeness of me or anyone assigned guardianship to me, as they deem appropriate in its promotional materials or team films.
COVID-19
Assumption of the Risk and Waiver of Liability Relating to Coronavirus/COVID-19
The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. COVID-19 is extremely contagious and is believed to spread mainly from person-to-person contact. As a result, federal, state, and local governments and federal and state health agencies recommend social distancing and have, in many locations, prohibited the congregation of groups of people.
Sportsplex West has put in place preventative measures to reduce the spread of COVID-19; however, we cannot guarantee that you will not become infected with COVID-19. Further, attending Sportsplex West could increase your risk of contracting COVID-19.
By signing this agreement, I acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that I or my children/individuals in my care, may be exposed to or infected by COVID-19 by attending Sportsplex West and that such exposure or infection may result in personal injury, illness, permanent disability, and death. I understand that the risk of becoming exposed to or infected by COVID-19 at Sportsplex West may result from the actions, omissions, or negligence of myself and others, including, but not limited to, SPORTSPLEX WEST employees, volunteers, and program participants and their families.
I voluntarily agree to assume all of the foregoing risks for myself and those in my care and accept sole responsibility for any injury to myself (including, but not limited to, personal injury, disability, and death), illness, damage, loss, claim, liability, or expense, of any kind, that I may experience or incur in connection with my attendance at SPORTSPLEX WEST or (“Claims”). On my behalf, I hereby release, covenant not to sue, discharge, and hold harmless SPORTSPLEX WEST, its employees, agents, and representatives, of and from the Claims, including all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating thereto. I understand and agree that this release includes any Claims based on the actions, omissions, or negligence of SPORTSPLEX WEST, its employees, agents, and representatives, whether a COVID-19 infection occurs before, during, or after participation in any SPORTSPLEX WEST program.
